Membership Agreement

 

1. Parties

a) HARMONİ KOZMETİK SANAYİ VE TİCARET A.Ş., located at Perpa Trade Center A Block, 5th Floor, No:183, Okmeydanı – ISTANBUL, operating the website https://jijivishacosmetics.com/en/ (hereinafter referred to as the “Seller”).

b) The internet user who becomes a member of the website https://jijivishacosmetics.com/en/ (hereinafter referred to as the “Member”).

2. Subject of the Agreement

The subject of this Agreement is to determine the conditions under which the Member benefits from the Seller’s website https://jijivishacosmetics.com/en/.

3. Rights and Obligations of the Parties

3.1. The Member declares and undertakes that the personal and other information provided while registering to the website https://jijivishacosmetics.com/en/ is true and correct under the law, and that the Member shall immediately compensate any and all damages incurred by the Seller due to false information provided.

3.2. The Member may not share the password provided by the Seller with third parties or organizations. The right to use such password belongs exclusively to the Member. Any liability arising from the use of the password by unauthorized parties shall rest with the Member, and the Seller reserves the right to claim indemnification against any and all damages and claims brought by third parties or authorities due to unauthorized use.

3.3. The Member undertakes to comply with legal provisions while using the website https://jijivishacosmetics.com/en/ and not to act in violation of such provisions. Otherwise, all legal and penal liabilities shall rest exclusively with the Member.

3.4. The Member may not use the website https://jijivishacosmetics.com/en/ in a manner that disrupts public order, violates general morality, disturbs or harasses others, serves unlawful purposes, or infringes the intellectual and copyright rights of others. Furthermore, the Member may not engage in activities (spam, virus, trojan horse, etc.) that prevent or complicate others’ use of the services.

3.5. Opinions and thoughts expressed, written, or used by Members on the website belong solely to the Members themselves and are their personal views. Such opinions and thoughts have no connection with the Seller. The Seller bears no responsibility for any damages that may be suffered by third parties due to Members’ statements, or by Members due to third parties’ statements.

3.6. The Seller shall not be held liable for unauthorized reading of Member data or for any damages to Member software and data. The Member accepts in advance not to demand compensation from the Seller for any damages arising from the use of the website https://jijivishacosmetics.com/en/.

3.7. The Member undertakes not to access or use other internet users’ software or data without permission. Otherwise, all legal and penal responsibilities shall rest with the Member.

3.8. The Member violating one or more of the clauses in this membership agreement shall be personally responsible both legally and criminally and shall hold the Seller harmless from the legal and penal consequences of such violations. In the event the violation is taken to legal authorities, the Seller reserves the right to claim compensation from the Member for breach of the membership agreement.

3.9. The Seller reserves the right to delete a Member’s membership and to delete any files, documents, or information belonging to the Member at any time, unilaterally. The Member accepts this right in advance, and the Seller shall not bear any responsibility in this regard.

3.10. The software and design of the website https://jijivishacosmetics.com/en/ are the property of the Seller and are protected by copyright and/or intellectual property laws. They may not be used, acquired, or altered without authorization. Other companies and products mentioned on this website are trademarks of their respective owners and are likewise protected.

3.11. In order to improve and develop the website or within the framework of legal regulations, information such as the name of the Internet service provider used to access the website, IP address, date and time of access, pages accessed during use, and the referring website address may be collected.

3.12. The Seller may use Members’ personal information to provide better services, improve products and services, and simplify site use in line with Members’ preferences and interests. The Seller reserves the right to keep records of the Member’s actions on the website.

3.13. By becoming a Member, the Member agrees to receive product and service promotions, advertisements, campaigns, surveys, and other customer satisfaction practices from the Seller. The Member accepts the collection, sharing, use, and archiving of personal and shopping information provided in the past or future for such purposes. Unless stated otherwise, this shall continue even if the membership ends. The Member also accepts to be contacted via internet, phone, SMS, etc. The Member accepts not to claim damages of any kind resulting from such collection and use of data. If the Member wishes to change their data-sharing preferences, they may inform the Seller’s customer service.

3.14. The Seller may disclose the Member’s personal information when required by law or in good faith if (a) it is necessary to comply with legal obligations or official notices; (b) it is deemed necessary to protect and defend the rights and property of the Seller and its website family.

3.15. The Seller has taken measures within its capabilities to ensure the website is free of viruses and similar malicious software. However, for ultimate protection, the Member must provide their own antivirus system. By accessing the website, the Member accepts responsibility for all errors and consequences that may arise in their software and systems.

3.16. The Seller reserves the right to change the content of the website, alter or terminate any service provided to users, or delete user information and data registered on the website at any time.

3.17. The Seller may change, update, or cancel the terms of the membership agreement at any time without notice. Such changes shall be effective for all Members on the date of publication.

3.18. The Parties agree that all computer records of the Seller shall constitute the sole and exclusive evidence under Article 287 of the Turkish Code of Civil Procedure, and such records constitute an evidence agreement.

3.19. The Seller is entitled to send informational emails to Members’ registered email addresses and SMS notifications to Members’ mobile numbers. By approving this membership agreement, the Member is deemed to have accepted the sending of such emails and SMS notifications.

4. Termination of Agreement

This Agreement shall remain in force until the Member cancels their membership or the Seller cancels it. The Seller may terminate the Member’s membership unilaterally if the Member violates any clause of this Agreement.

5. Settlement of Disputes

Consumer Courts and Enforcement Offices are authorized for disputes arising from this Agreement.

6. Enforcement

By registering as a Member, the Member declares that they have read and accepted all provisions of this membership agreement. This Agreement is deemed to have been mutually concluded and entered into force at the time the Member registered.
